Claiming Damages if You Were Hurt in a Crash with a Taxi, Uber or Lyft

If you were a passenger in a cab or rideshare vehicle, or if you were in another car entirely, you can make a claim for compensation if you were injured in an accident. Sadler Bailey explains what to do in the following videos.

Who Is Responsible if I’m Hurt in a Taxi?

It depends. If the taxi driver is at fault, then the taxi company is responsible. Under the Shelby County rules, the taxi company’s gonna have to have half a million dollars in liability and uninsured motorist coverage. You’re asking a question with a lot of scenarios. If someone else runs a light or is negligent and injures you while you are in a taxi, then you have all kinds of sources of recovery. The responsible person who hit the taxi will have coverage. The taxi company will have coverage. Your own personal liability coverage would apply if the other two were unavailable. There are various sources, but the short answer is, “Yes.” If you’re a passenger in a taxi, there will be coverage in a situation like that.

Who Is Responsible if I’m Hurt in an Uber?

If you’re a passenger in an Uber vehicle, it depends, of course, on who was at fault in this wreck. If someone hits the Uber vehicle, then that person is liable. If that person happens to be uninsured, the good news is that Uber is required by law to have a million dollars in coverage for underinsured or uninsured motorists. Of course, if the Uber the driver is at fault, you will also be able to recover under the liability policy, also a million dollars. Yes, these things happen all the time. We represent people who are passengers in Uber vehicles with some regularity. Who Is Responsible if I’m Hurt in a Lyft?

If you’re hurt while you’re a passenger in a Lyft vehicle, it’s going to depend, of course, first of all who’s at fault. If someone else hits the Lyft vehicle, there is coverage on that Lyft vehicle of $1 million. That’s Tennessee law that they have to have at least $1 million that would cover liability, meaning if the Lyft driver was at fault, or insured motorist coverage in case the person that hit the Lyft was at fault. So, yes, you would be covered.
