Mr. Greer explains that there is a misconception about whether limiting jury verdict awards in Tennessee will reduce frivolous lawsuits. Most people do not know that there are already protections within the civil justice system that cause frivolous lawsuits to be dismissed by the judge.  Rather than preventing frivolous lawsuits, placing an arbitrary cap on damages effects only those people with a legitimate case and serious injuries. By limiting damages, corporations and insurance companies are able to escape personal responsibility and accountability, which causes them to be less safe in the future.
