Tennessee Workers’ Comp Basics: What to Do if Injured on the Job

If you are injured on-the-job in Tennessee, the Tennessee worker’s compensation insurance program is designed to help you. Through a federally mandated program, every employer in the state with five or more full or part-time employees is required to carry workers’ comp insurance.

This insurance is also mandated for all employers in the construction or mining industries, but exempts state and local governments and employers of farm laborers or domestic help. However, these agencies may elect to provide coverage.

If you are injured on-the-job, there is a process to follow.

If injured, report your injury immediately to your employer.

Your employer will then complete a “First Report of Injury”.

Your employer will offer you a panel of physicians to see.

You will choose one physician who becomes your authorized treating physician.

Your employer pays this physician.

Next, you must complete Form C42, “Agreement Between Employer/Employee Choice of Physician”. Your employer keeps this form on file.

At this point, you should be treated and your sick time covered by the employer.

When the system fails you:
While this process sounds like it has you covered, too many times problems arise and the employee finds that the system has not worked for him. This can happen for many reasons, but here are a few:

Your injury is found not to be compensable.

Your physician turns out not to be authorized by the employer.

You are fired or terminated from your job because of your claim.

The statute of limitations runs out.

If you or a loved one has been injured on-the-job, you should contact a Memphis workers’ comp lawyer immediately at the first sign of trouble. The law is complicated and there are many ways that your employer’s insurance company can save itself money at your expense.

Call Bailey & Greer today toll-free at 888-470-9143 if you feel that your mandated rights are being compromised. We have the experience and professional resources to help you get you the compensation you deserve.

What Happens When You File a Tennessee Legal Malpractice Lawsuit?

You hired an attorney to represent you. You expected the best and got the worst. Your lawyer made mistakes and now you are left with an empty wallet and little recourse. Sound familiar? Maybe you are one of the unlucky ones – a victim of Tennessee legal malpractice.

But don’t despair; you need to move on and right these wrongs. Tennessee law provides protection for people like you, and you should definitely take advantage of this fact. Call a legal malpractice lawyer in Memphis today and get started on getting even. When you hire an experienced, caring legal firm like Bailey & Greer to handle your Tennessee legal malpractice lawsuit, you know that you have done everything you can to right the wrongs.

Here are some of the initial steps your attorney may take to represent your best interests:

Draft a complaint that names your former lawyer as defendant. This complaint will include the facts of your case and demonstrate that these facts constitute legal malpractice. It will show how your case might have had a different outcome if your lawyer had acted in a different manner.

Complete a summons form from the county local court. This summons outlines the basic charges and informs your former attorney that he or she is being sued.

Hire a process server to deliver the complaint. This step ensures that the defendant in your case is notified of the legal action being taken and cannot claim he or she didn’t know about it.

Build a case against the defendant. Once the initial steps have been taken to initiate the lawsuit, your counsel will begin the tedious and complicated task of reviewing the original case, collecting evidence that legal malpractice has occurred, filing court documents, and preparing for trial if necessary.

While is it possible to complete some of these steps yourself, almost no one does because of the complexity surrounding Tennessee legal malpractice lawsuits. Your best bet is to hire a reputable, caring and experienced attorney to represent you. Call Bailey & Greer in Memphis toll-free at 888-470-9143 today to get started. You can also fill out the confidential form on this page and we will contact you right away.

If you are one of the many women who have received a mesh implant to deal with organ prolapse, or urinary incontinence, and are experiencing significant complications, then you should know that litigation against the companies that made and distributed these devices is proceeding. We are representing dozens of clients suffering from failed mesh devices, and are happy to report that on May 1, 2011, U.S. District Court Judge Joseph R. Goodwin picked a trial date for the first 600 pelvic mesh cases against C.R. Bard. Plaintiffs allege that Bard's AVAULTA device caused organ damage, among other "devistating consequences." Hundreds of civil actions against Bard have been consolidated in Multi-District Litigation (MDL 2187) in Charleston, West Virginia. The Bard MDL is one of four MDLs involving other manufacturers' defective products, including: Johnson & Johnson's Ethicon division (MDL 2327); American Medical Systems (MDL 2325), and Boston Scientific (MDL 2326). C.R. Bard and J&J"s Ethicon division are also facing mass-tort litigation in the state courts of New Jersey, where they are headquartered. More than 75,000 women each year have devices inserted in an attempt to support organs that are pushing, or bulging, out of place (known as organ prolapse), or for urinary incontinence. We will keep you updated on these MDLs as they progress.

What to Do When a Dangerous Prescription Drug Hurts You

When the Food and Drug Administration (FDA) approves a drug, we like to think that drug has been rigorously tested and deemed safe for us to use. Unfortunately, that is very often not the case at all.

Too many times, prescription drugs are inadequately tested, rushed to market before they are fully understood and information about the drug is even withheld. Knowing these things, the Memphis dangerous drug lawyers at Bailey & Greer, take a special interest in helping you, the consumer, be aware of just how risky many FDA approved drugs really are.

For example, in 1997 the FDA approved the drug Propecia, which is prescribed for male baldness for use in the United States. Since then, many men have taken this drug assuming that they were safe.

However, in April of 2012, the FDA reported that they had received 421 cases of male sexual problems in those using Propecia. These problems included erectile dysfunction, decreased libido, difficulty with ejaculation, and orgasm problems. And, these problems lasted at least three months after the men discontinued using the drug.

So now the FDA has ordered the Propecia manufacturer, Merck, to add these side effects to their warnings. The new labels will also add language describing reported cases involving male infertility and even poor semen quality.

This is just one example of the problems that exist in our country’s prescription drug safety. In this case, the drug was used for 15 years before the additional side effects were recognized and warnings issued to the public.

If you or a loved one was harmed by the side effects of a dangerous prescription drug, you may want to consult a lawyer to discuss your legal rights. Bailey & Greer, Memphis dangerous drug lawyers, can handle your questions and your case if you need us.

For a free case consultation, call us toll free at 888-470-9143 or fill out the confidential form on this page. We serve the victims of dangerous prescription drugs nationwide.

Signs and Symptoms of Tennessee Nursing Home Neglect

We all want to think that every senior is well cared for and loved in nursing homes, yet all too often this is not the case. Tennessee nursing home neglect can be happening right under our noses and sometimes we don’t know until it is too late.

For this reason, we should all be vigilant and recognize the signs and symptoms of neglect. There are some common factors to look out for when visiting the elderly:

Bedsores. One sure sign that your loved one is not getting the full attention of the staff is the appearance of bedsores. Bed-ridden patients should be turned regularly and sores tended to.

Dehydration or weight loss. If a nursing home resident always asks for water when you visit and there is none in sight, or you notice a sudden loss of weight, there is a chance that his or her basic needs are not being met.

Unsanitary conditions. Foul odors, dirty floors and unmade or dirty beds signal a lack of sanitation in nursing homes.

An unkempt appearance. When you visit, look carefully at the appearance of your loved one. Residents of good nursing homes will always be dressed during the day in clean clothes, with clean and groomed hair and nails.

New or recurring illnesses or infections. Of course, everyone can come down with the common cold or infection. But when this happens too often or seems to go unnoticed, you need to get involved.

Patients wandering. If you routinely see patients in a nursing facility wandering the halls aimlessly and alone, there may not be enough staff to watch out for your loved one.

Lack of mobility or even frozen joints. Good nursing facilities make sure each resident is given proper exercise, within the limits of his or her ability.

Frequent falls. If your loved one falls often, lack of supervision may be the culprit.

Unanswered complaints. Listen to the complaints when you visit. They could be being ignored.

Sudden and unexplained death. The worst case scenario, every death should be explained fully.

All of these signs may point to Tennessee nursing home abuse through neglect. Contact a Memphis nursing home abuse lawyer immediately if you suspect it.
Panel of Doctors Says Malpractice is Not to Blame for Rising Healthcare Costs

At the Avoiding Avoidable Care conference held on April 25-26, 2012, a panel of expert physicians acknowledged that malpractice lawsuits are not a serious contributing factor to the ever rising cost of healthcare. Overall, malpractice related expenditures, which include payments to people who have been legitimately injured or killed as a result of medical malpractice, account for only 2% of healthcare spending.

Amitabh Chandra, an economist who attended the conference, questioned whether overhauling the medical legal system in America would have any effect on controlling costs. His sentiments seemed to be confirmed by other doctors.

For instance, Dr. Jerome Hoffman stated that malpractice is "such an unimportant element of what is going on." Dr. Hoffman also said that the threat of being sued was much less when he started practicing medicine, but that physician behavior remains similar today. Dr. Hoffman indicated that so called defensive medicine was the result of a cultural fear of uncertainty and fear of getting something wrong, rather than from a fear of being sued.

Although it will not reduce healthcare costs, the effect of so called medical malpractice "reform" will certainly reduce the average citizen's right to be made whole following a medical injury. In fact, efforts to place caps on damages will affect the most seriously injured patients with the most legitimate claims. Given that these "reforms" will not reduce costs and will negatively affect those in legitimate need of compensation, it is clear that the proponents of malpractice reform are really concerned with increasing profits for medical liability insurance companies and major corporations, not in protecting patients and bringing down the cost of healthcare.

Tip of the hat to White Coat Notes for bringing this story to my attention.

Who Can File a Tennessee Wrongful Death Claim?

Wrongful deaths cause pain, emotional turmoil, and even financial distress for the survivors of a loved one. Because state and not federal law governs wrongful death, Tennessee has its own set of statutes. If you live in the Memphis area, it is important to consult a Memphis wrongful death lawyer to determine what your rights are.

When a loved one dies due to the negligence or intention of another, the law defines the death as wrongful. This means that a personal representative of the decedent has the right to sue on behalf of the survivors. So, who can act as a personal representative in a Tennessee wrongful death lawsuit?

In general, the following rules apply to Tennessee wrongful deaths:

A wife, estate administrator or executor can file a lawsuit for the death of a husband.

And if a husband survives his wife, he or an administrator or executor can file.

When wrongful death occurs to a single person, his or her adult children may file. If there are no adult children, then the parents are next in line.

When the decedent is a minor and unmarried, his or her parents or estate administrator may file suit.

If the victim of wrongful death’s parents are deceased and he or she has no children, Tennessee law allows a sister or brother to file.

Of course, like any rules, there are exceptions. For instance, if there is more than one person who may file suit, the court will decide who actually does so. No matter what your situation, legal representation is your best choice. A Tennessee wrongful death attorney can advise you of your rights and the best way to approach a wrongful death lawsuit.

Bailey & Greer, in Memphis, represents families with compassion and legal expertise.
When the day is beautiful and you hit the open road on your motorcycle, the last thing you might expect is to be injured because someone, somewhere allowed a defect to go unnoticed. But sadly, this happens all too often, causing needless suffering for Tennessee motorcycle riders.

As Memphis motorcycle crash lawyers, we hear all too often about cases of defective product liability. In these cases, no matter how careful the motorcyclist is, he or she can be seriously injured because of a defect in either design or defective manufacturing.

The National Highway Safety Administration (NHSTA) oversees the safety of all Americans who travel our highways and byways. The NHSTA sets and requires vehicle safety standards for all motor vehicles, including motorcycles. They can order safety recalls and even pull unsafe vehicles from the market.

Yet, even with the NHSTA doing all it can to protect us, defective product liability continues to cause serious Tennessee motorcycle accidents. For this reason, this type of case is heard regularly throughout the country.

To prove a Memphis defective liability motorcycle claim, you will need to:

Find and retain a reputable, experienced, aggressive legal team.

Prove that a defect in your equipment existed or exists.

Prove that you have sustained injuries as a result of the defect.

OR, prove that you were not warned about the defect.

AND, prove that you were using the defective machinery or part in the way it was intended to be used.

Don’t wait to find out if you do, indeed, have a viable claim.
Tennessee slip and fall accidents happen every day. In fact, this type of accident is one of the most common in the United States. An estimated one million Americans are injured each year when they slip and fall. According to the Center for Disease Control and Prevention (CDC), about 20,000 of these people die as a result of their injuries.

With numbers like these, slip and fall accidents should not be taken lightly. While sometimes frivolous lawsuits are filed, giving this area of the law a bad name, Memphis slip and fall lawyers at Bailey & Greer know from experience that slip and fall injuries are often preventable and that premises liability laws exist to protect the people, not to make them money.

So, what are the chances that you might be a slip and fall injury victim? Here are some facts and figures to help answer this question:

People over 65 years of age are most likely to suffer moderate to severe injuries in these accidents. In 2008, 82% of deaths due to falls happened to older victims.

Slip and fall accidents are a leading cause of visits to hospital emergency rooms. About one million, or 12%, of total falls leading to ER visits are caused by slip and fall.

Slip and fall accidents are the main cause of workers’ compensation claims and are the leading cause of work-related injuries for younger people, ages 15-24.

About an equal number of women as men die in fall-related accidents on level surfaces.

About 5% of people who slip and fall suffer fractures, and these are the most serious injuries.

Inadequate or poorly maintained floors and flooring materials play a role in over two million fall injuries each year.

If you have suffered a serious Memphis slip and fall injury and feel that someone else caused your injury, you should consult a lawyer. The personal injury specialists at Bailey & Greer can help. We offer a free initial consultation. Just call us toll-free at 888-470-9143 or fill out the confidential form on this page.

In-Flight Negligence Claims on Airlines and Air Carriers

The fact that airplanes fly is one of the truly remarkable achievements of modern man. Perhaps no matter how many times you have flown, watching the cars, houses and woodlands become smaller and smaller as the plane lifts to the clouds still fills you with wonder and awe.

Most of the time, the plane lands at your destination safely and comfortably, but, as Tennessee airline accident lawyers, we know that sometimes passengers are injured while in-flight. When this happens, legal advice regarding negligence is the best course of action.

Negligence claims are commonly filed when an airline employee – a pilot, flight attendant, maintenance worker or ground crew member – is careless or inattentive and a passenger is injured.

When you board a commercial airplane, the Federal Aviation Act (FAA) protects you. The FAA requires that all airlines and air carriers do everything within their power to ensure safety for all passengers. In fact, airlines are held to what is called a “common carrier standard”. This standard means that a heightened degree of care is demanded throughout the time that passengers board, travel onboard, and disembark the plane.

So, if you are tripped by an object left in the aisle of a plane, hit by a wayward beverage cart, bombarded by luggage falling from an improperly fastened overhead bin or not warned about turbulence in time to fasten your seatbelt, it can be argued that someone was negligent in ensuring your safety.

In order to prove negligence by an airline, you will definitely need an attorney who knows the FAA regulations and special common carrier standards. Bailey & Greer offers both experience and a caring, professional approach to your personal injury case. If you have questions about an in-flight accident, please call us toll-free today at 888-470-9143. Or, simply fill out the confidential form on this page and we will contact you.

There have been numerous reports that experienced ATV riders have been injured and even killed when the throttle sticks on a Yamaha Grizzly. When it happens to someone else, it is easy for those not involved to say that they would have done things differently, like hit the kill switch or use the brakes. However, most riders do not anticipate that the throttle will ever stick so when it happens, the rider can be caught off guard and not know exactly what to do. Also, many times there is not enough time for the rider to do anything before being thrown off or hitting a tree.

For instances, one rider reported that as soon as he turned the ignition and gave the ATV some gas, the throttle stuck and the ATV was in full throttle. Within a matter of seconds, the Grizzly 660 was traveling at a high rate of speed. If this happens in a wooded area, there is no time for the rider to react before striking a tree or some other obstacle. In addition, there have been reports that applying the brakes will not stop the Grizzly ATV if the throttle is stuck. Often times after the rider jumps off or is thrown off, the ATV continues to travel on its own. To make matters worse, medical treatment for injuries may be difficult to obtain due to the rural locations that many ATV riders enjoy.

An Experienced Yamaha Grizzly Attorney Can Help

Do not expect Yamaha to take responsibility for your injuries. Despite numerous reports of this dangerous problem, Yamaha has never issued a recall or warning about the defect. The experienced ATV attorneys at Bailey & Greer can handle your product liability claim against Yamaha anywhere in the country.
How to Cope With Grief in a Tennessee Wrongful Death

Ask anyone who has experienced the loss of a loved one. It hurts and there is no way to change that. Grief is a perfectly natural and unavoidable process that everyone must go through. But, when the death is wrongful, due to the negligence of someone else, the pain can be so much more intense because of the sometimes overwhelming feelings of anger.

Dealing with this grief and anger is not easy for anyone. As middle Tennessee wrongful death lawyers, we see many clients who are struggling with just these things. Here are a few facts about grief that everyone should know:

Everyone grieves differently. Some people take more time to heal, others less. There is no timetable, and you should never feel pressured or rushed to “get over it”.

You should never try to ignore your pain. It is a necessary step in healing to face the grief and learn how to deal with it.

You do not have to be strong. Feelings of loneliness, sadness and fear are all normal in the grieving process.

You will heal. Everyone finally does heal after a loss, but this can take time. Allow yourself the time you need to cope.

Professionals offer very good advice for anyone moving through the grieving process. This advice includes:

Find support. There are many avenues of support available to you. You do not have to suffer alone. Allow friends, family, and faith to come into your life and share the pain with you. There are also many good support groups and counselors in just about every neighborhood.

Take good care of yourself. While it may be easy to let things go after a loss, it is important to care for yourself more than ever. Try to face how you feel, talk or write about your feelings and prepare yourself for events that may trigger a grief reaction. Also, be sure to get plenty of sleep, eat right and get some regular exercise. The body and mind are closely connected.

Know what to do if the grief doesn’t lessen. Sometimes the grief just doesn’t seem to go away. If your grief is getting worse, or if you do not seem to be improving, consider getting professional help, as you could be suffering depression. You could also be having prolonged grief because you have not dealt with underlying issues, one of which is the anger that comes with a wrongful death.

While there is no hurry to file a claim against the person or entity that harmed your loved one, eventually you may wish to pursue this route. As middle Tennessee wrongful death lawyers, we know you can heal through the closure of a wrongful death lawsuit. By filing one, you are taking an important step in dealing with the actual cause of your grief.

We encourage you to call Bailey & Greer when you are ready to find closure. We can be reached toll-free at 888-470-9143. We can help.
