• If injured, report your injury immediately to your employer.
• Your employer will then complete a “First Report of Injury”.
• Your employer will offer you a panel of physicians to see.
• You will choose one physician who becomes your authorized treating physician.
• Your employer pays this physician.
• Next, you must complete Form C42, “Agreement Between Employer/Employee Choice of Physician”. Your employer keeps this form on file.
• At this point, you should be treated and your sick time covered by the employer.

• Your injury is found not to be compensable.
• Your physician turns out not to be authorized by the employer.
• You are fired or terminated from your job because of your claim.
• The statute of limitations runs out.

• Draft a complaint that names your former lawyer as defendant. This complaint will include the facts of your case and demonstrate that these facts constitute legal malpractice. It will show how your case might have had a different outcome if your lawyer had acted in a different manner.
• Complete a summons form from the county local court. This summons outlines the basic charges and informs your former attorney that he or she is being sued.
• Hire a process server to deliver the complaint. This step ensures that the defendant in your case is notified of the legal action being taken and cannot claim he or she didn’t know about it.
• Build a case against the defendant. Once the initial steps have been taken to initiate the lawsuit, your counsel will begin the tedious and complicated task of reviewing the original case, collecting evidence that legal malpractice has occurred, filing court documents, and preparing for trial if necessary.

• Bedsores. One sure sign that your loved one is not getting the full attention of the staff is the appearance of bedsores. Bed-ridden patients should be turned regularly and sores tended to.
• Dehydration or weight loss. If a nursing home resident always asks for water when you visit and there is none in sight, or you notice a sudden loss of weight, there is a chance that his or her basic needs are not being met.
• Unsanitary conditions. Foul odors, dirty floors and unmade or dirty beds signal a lack of sanitation in nursing homes.
• An unkempt appearance. When you visit, look carefully at the appearance of your loved one. Residents of good nursing homes will always be dressed during the day in clean clothes, with clean and groomed hair and nails.
• New or recurring illnesses or infections. Of course, everyone can come down with the common cold or infection. But when this happens too often or seems to go unnoticed, you need to get involved.
• Patients wandering. If you routinely see patients in a nursing facility wandering the halls aimlessly and alone, there may not be enough staff to watch out for your loved one.
• Lack of mobility or even frozen joints. Good nursing facilities make sure each resident is given proper exercise, within the limits of his or her ability.
• Frequent falls. If your loved one falls often, lack of supervision may be the culprit.
• Unanswered complaints. Listen to the complaints when you visit. They could be being ignored.
• Sudden and unexplained death. The worst case scenario, every death should be explained fully.

• A wife, estate administrator or executor can file a lawsuit for the death of a husband.
• And if a husband survives his wife, he or an administrator or executor can file.
• When wrongful death occurs to a single person, his or her adult children may file. If there are no adult children, then the parents are next in line.
• When the decedent is a minor and unmarried, his or her parents or estate administrator may file suit.
• If the victim of wrongful death’s parents are deceased and he or she has no children, Tennessee law allows a sister or brother to file.

• Find and retain a reputable, experienced, aggressive legal team.
• Prove that a defect in your equipment existed or exists.
• Prove that you have sustained injuries as a result of the defect.
• OR, prove that you were not warned about the defect.
• AND, prove that you were using the defective machinery or part in the way it was intended to be used.

• This legislation allows insurance companies to use trickery to change policies without knowledge or consent.  Anyone who buys insurance will be equally harmed under this legislation - both businesses and consumers. 
• If an insurance company puts a change to your policy in the fine print in a piece of junk mail and you do not see the change, or much less agree to it, the change to your policy can be binding by mere payment of your bill.  An automatic bill payment out of your checking account will be enough to allow them to completely change your policy. 
• A contract is made when both sides reach an agreement, but this legislation allows insurance companies to decide what the contract is without your knowledge and without your agreement.  Insurance companies should not be allowed to change the rules in the middle of the game.
• The U.S. insurance industry has trillions of dollars in assets, enjoys average profits of over $30 billion a year, and pays its CEOs more than any other industry.  This is just another example of how they still engage in dirty tricks and unethical behavior to boost their bottom line even further.

• People over 65 years of age are most likely to suffer moderate to severe injuries in these accidents. In 2008, 82% of deaths due to falls happened to older victims.
• Slip and fall accidents are a leading cause of visits to hospital emergency rooms. About one million, or 12%, of total falls leading to ER visits are caused by slip and fall.
• Slip and fall accidents are the main cause of workers’ compensation claims and are the leading cause of work-related injuries for younger people, ages 15-24.

• Take good care of yourself. While it may be easy to let things go after a loss, it is important to care for yourself more than ever. Try to face how you feel, talk or write about your feelings and prepare yourself for events that may trigger a grief reaction. Also, be sure to get plenty of sleep, eat right and get some regular exercise. The body and mind are closely connected.
• Know what to do if the grief doesn’t lessen. Sometimes the grief just doesn’t seem to go away. If your grief is getting worse, or if you do not seem to be improving, consider getting professional help, as you could be suffering depression. You could also be having prolonged grief because you have not dealt with underlying issues, one of which is the anger that comes with a wrongful death.
