Does Capping Jury Awards Reduce Frivolous Lawsuits?

 

A: Tennessee recently placed an arbitrary cap on the amount of money a jury can provide in a Tennessee personal injury or wrongful death case. The law states that the amount of non-economic damages a jury can provide is generally capped at $750,000, with certain limited exceptions which allow for a higher amount.  This cap will apply to personal injury and wrongful death actions such as auto and truck accidents, medical malpractice cases, and premises liability lawsuits.  The law applies to any claim that occurs after October 1, 2011.
