A jury in Jackson, Tennessee returned a verdict today totaling $1.5 million. This wrongful death lawsuit was filed in 2009 against a local day care, Lambuth Memorial Preschool, following the death of a toddler. The child, who was just twenty-two months old at the time, was left unsupervised during mealtime when he began to choke on a peach. He soon lost consciousness, suffered severe brain damage, and died a few days later. Despite clear evidence that the day care ignored important safety rules, it refused to accept financial responsibility for the death. This verdict shows the importance of day care safety and the devastating loss that can result when a day care chooses to ignore generally accepted and state mandated safety rules.
